Bylaws: In NSW Strata Schemes are regulated by, inter alia, the Strata Scheme Management Act 2015 (SSMA 2015) and the Strata Scheme Management Regulation 2016 (SSMR 2016), as amended and updated. Part 7 of the Act deals with Bylaws and includes procedures for their enforcement.

In this document you will find:
– By-laws that owners, occupiers and, in some cases, visitors must follow. By-laws cover issues such as whether or not pets are permitted on the scheme, how smoking is regulated, parking, noise, and the conduct of residents and visitors.
– The “Common Property Memorandum” which explains which parts of the building are “common property” owned by the Owners Corporation; and those parts considered “lot property” owned by the Lot Owner., and
– The “Architectural Code” which sets out the principles to maintain the architectural integrity of the building and therefore relate primarily to the external appearance and safety of the building.
– Special by-laws that document special conditions that apply to specific lots. These are binding on the owner, from time to time, of the lot.
